Terms of Service

Welcome to Elite Motorworks Ltd. These Terms of Service ("Agreement") govern the use of our mobile mechanic services in Cheltenham, Gloucestershire, and surrounding areas. By booking or using our services, you agree to the terms outlined below. Please read them carefully. Your statutory rights as a consumer are not affected by this Agreement.

1. Introduction

Elite Motorworks Ltd ("we," "us," or "our") provides mobile vehicle diagnostics, repairs, servicing, and restoration for all makes and models, including high-performance and classic vehicles. This Agreement is legally binding and governed by the laws of England and Wales. Nothing in this Agreement affects your statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.

2. Your Statutory Rights (Consumer Rights Act 2015)

As a consumer, you have statutory rights that cannot be excluded or limited by this Agreement. Under the Consumer Rights Act 2015:

  • All services will be performed with reasonable care and skill.
  • Work will be completed within a reasonable time where no specific timeframe has been agreed.
  • Any information we provide to you before the contract is formed (including verbal estimates and service descriptions) forms part of the contract.
  • If our services do not meet these standards, you have the right to request repeat performance or a price reduction.

3. Scope of Services

3.1 Services Provided

We offer mobile and workshop services, including diagnostics, repairs, maintenance, pre-purchase inspections, restoration, and parts sourcing. Availability may vary based on location, vehicle type, and feasibility.

3.2 Booking Appointments

All services must be pre-scheduled and confirmed electronically or in writing. We reserve the right to decline service requests for safety, regulatory, or logistical reasons.

3.3 Estimates

Estimates are based on your description of the issue and may be revised after diagnostics or if unforeseen issues arise. If the revised cost exceeds the original estimate by more than 20% or £100 (whichever is lower), we will pause work and contact you for approval before proceeding. No additional work will be carried out without your agreement.

4. Your Right to Cancel (Consumer Contracts Regulations 2013)

4.1 Statutory Right to Cancel

Because our services are booked remotely (by phone, email, or online) and performed at your location, you have a statutory right to cancel this contract without giving any reason within 14 calendar days of the booking being confirmed. To exercise this right, contact us at [email protected] or 01242 350661 before the cancellation period expires.

4.2 Requesting Early Start of Service

If you request that we begin work within the 14-day cancellation period, you acknowledge that your cancellation right will be partially waived. If the service is fully completed within that window, the right to cancel is lost entirely. You may still be charged proportionally for work already completed if you cancel after work has begun.

4.3 Model Cancellation

To cancel, please notify us in writing (email is acceptable) with your name, booking reference, address, and the date of booking. We will confirm receipt and process any applicable refund within 14 days.

4.4 Client-Initiated Changes Outside the Statutory Period

Cancellations or reschedules outside the statutory 14-day window must be made at least 24 hours before the scheduled appointment. Cancellations made with less than 24 hours' notice — where the statutory right to cancel does not apply — may incur a charge of up to 50% of the agreed estimate to cover preparation, parts ordered, and time reserved.

4.5 Company-Initiated Changes

We may reschedule due to weather, safety concerns, or parts unavailability. We will inform you promptly and arrange a mutually convenient alternative time at no additional cost.

5. Client Responsibilities

5.1 Accurate Information

Clients must provide accurate vehicle details and disclose all known issues prior to work commencing. Failure to disclose known issues may affect warranty coverage for those specific issues and may result in a revised estimate. Work will not proceed beyond the initial assessment without your cost approval.

5.2 Safe and Accessible Work Location

The service location must be safe, accessible, reasonably level, and compliant with local regulations. If we are unable to safely carry out work at the agreed location, we reserve the right to reschedule at no penalty to either party.

5.3 Payment Obligations

Full payment is due upon completion of work unless otherwise agreed in writing. Accepted payment methods: bank transfer, credit/debit card, or cash.

6. Warranty and Liability

6.1 Warranty

We provide a 12-month or 12,000-mile warranty (whichever comes first) on parts and labour supplied directly by Elite Motorworks Ltd. Warranty claims may require the vehicle to be made available for inspection.

6.2 Warranty Exclusions

The warranty does not cover: fair wear and tear; damage resulting from misuse (defined as use of the vehicle in conditions exceeding the manufacturer's specified operating limits, failure to maintain fluid levels, or use in applications the vehicle was not designed for); third-party parts; or modifications made by the client or any third party after our work was completed.

6.3 Client-Supplied Parts

No warranty applies to parts supplied by the client. We will carry out the work with reasonable care and skill but cannot warranty components we did not source.

6.4 Liability

Nothing in this Agreement limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be lawfully excluded or limited under applicable law including the Consumer Rights Act 2015.

Subject to the above, and to the fullest extent permitted by law, our total liability to you arising out of or in connection with the services shall not exceed the total amount paid by you for the specific service giving rise to the claim. We shall not be liable for indirect or consequential losses except where such exclusion is not permitted by applicable law.

7. Additional Costs

7.1 Travel Costs

Services requested beyond 20 miles from GL51 0PT incur a travel charge of £2 per mile. This will be disclosed to you at the time of booking.

7.2 Collection and Delivery

Vehicle collection and delivery is charged from £2.25 per mile. Elite Motorworks Ltd holds appropriate business insurance for the transport of vehicles by our recovery partners. We recommend clients independently confirm the position under their own motor insurance policy.

8. Service Standards

All work will be completed with reasonable care and skill, in line with the standards of a competent motor vehicle technician. If any work fails to meet this standard, we will correct it at no additional charge or, where correction is not reasonably possible, provide an agreed partial refund. This is in addition to your statutory rights under the Consumer Rights Act 2015.

9. Payment Terms

9.1 Prepayments

Services or parts orders exceeding £500 may require a prepayment, which will be confirmed in writing before work begins.

9.2 Progress Payments

For long-term repair or restoration projects, monthly progress payments may be required. This will be agreed and confirmed in writing at the outset.

9.3 Late Payments — Business Clients

For business-to-business transactions, balances unpaid after 30 days will incur statutory interest at 8% above the Bank of England base rate, calculated daily under the Late Payment of Commercial Debts (Interest) Act 1998, plus an £85 administration fee.

9.4 Late Payments — Consumer Clients

For consumer clients, balances unpaid after 30 days may incur a fair and proportionate interest charge of 4% per annum above the Bank of England base rate, calculated daily. This will be clearly communicated before any charge is applied.

10. Payment Plans

10.1 Interest-Free Instalments

We offer 0% interest finance through Payment Assist, allowing you to spread the cost of repairs over 3, 4, or 6 months. There are no hidden fees or interest charges when payments are made on time.

10.2 Eligibility

To qualify you must be 18 or older, a UK resident, and hold a valid UK-issued debit card.

10.3 How It Works

The total balance is divided into equal monthly payments collected automatically from your debit card. For full details, visit paymentassist.co.uk.

11. Insurance

Elite Motorworks Ltd holds public liability insurance and appropriate trade insurance for all work carried out on customer vehicles. Details of our cover are available on request. Clients are responsible for maintaining their own vehicle insurance and should confirm their policy position independently, particularly in relation to vehicles being transported by third parties.

12. Data Privacy

12.1 Data We Collect

We collect personal data (name, contact details, vehicle details) solely for the purpose of providing our services, communicating with you, and meeting our legal obligations. Elite Motorworks Ltd is the data controller for this information.

12.2 Legal Basis

We process your data on the basis of contract performance (to deliver the services you have booked) and legitimate interests (to manage our business effectively and maintain service records).

12.3 Retention

We retain your personal data for as long as necessary to fulfil the service and meet our legal obligations, typically no longer than 6 years from the date of the last transaction.

12.4 Your Rights

Under UK GDPR you have the right to access, correct, delete, restrict, or port your personal data, and to object to its processing. To exercise any of these rights, contact us at [email protected].

12.5 ICO

You have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.

12.6 Data Sharing

We will not share your personal data with third parties without your consent, except where required by law or where necessary to deliver the service (e.g. parts suppliers, recovery partners).

13. Marketing and Media

13.1 Photos and Videos

We will only use images or videos of your vehicle for marketing purposes with your explicit prior consent. If you are happy for us to use such content, please let us know in writing (email is acceptable). Number plates and any identifying personal information will be obscured unless you specifically agree otherwise.

13.2 Logo and Brand Usage

With your written approval, your business logo or brand name may be referenced in our promotional materials (e.g. fleet client case studies).

14. Force Majeure

Neither party shall be liable for any delay or failure to perform obligations under this Agreement where such delay or failure arises from circumstances genuinely beyond their reasonable control, including but not limited to severe weather, natural disasters, pandemic restrictions, supplier failure, or vehicle breakdown. In such circumstances, the affected party will notify the other as soon as reasonably practicable and will make all reasonable efforts to resume performance.

15. Dispute Resolution

15.1 Complaints

If you have a concern about our services, please contact us within 7 days of the service being completed. We will acknowledge your complaint promptly and aim to resolve it within 14 days.

15.2 Alternative Dispute Resolution

If we are unable to resolve a complaint to your satisfaction, you may refer the matter to an approved Alternative Dispute Resolution (ADR) body. An appropriate ADR body for automotive disputes is The Motor Ombudsman (themotorombudsman.org). We will consider ADR on a case-by-case basis.

15.3 Governing Law

This Agreement is governed by the laws of England and Wales. Any disputes that cannot be resolved through ADR will be subject to the jurisdiction of the courts of England and Wales.

16. Intellectual Property

16.1 Diagnostic Reports and Documentation

Any diagnostic reports, inspection write-ups, photographs, or documentation produced by Elite Motorworks Ltd in connection with your vehicle remain the intellectual property of Elite Motorworks Ltd. Copies provided to you are for your personal use only and may not be reproduced commercially or shared with third parties for commercial purposes without our written consent.

16.2 Client's Own Materials

Any documentation, schematics, or materials provided by the client to assist with a repair remain the property of the client.

17. Subcontracting and Third-Party Partners

17.1 Use of Third Parties

We may engage trusted third-party partners to assist with the delivery of our services — for example, vehicle recovery firms for transportation, or specialist workshops for work requiring facilities beyond our mobile setup. We will inform you when a third party will be involved in your service.

17.2 Liability for Third-Party Work

Where a third party is engaged to carry out work on your vehicle, we will take reasonable steps to ensure they operate to an appropriate standard. Our liability for third-party work is limited to the reasonable steps we took in selecting and instructing that third party. We are not responsible for losses arising from a third party's independent negligence beyond our reasonable control.

17.3 Parts Suppliers

Parts are sourced from reputable local suppliers. Where a part proves defective, we will liaise with the supplier on your behalf and replace or repair the affected component under our 12-month warranty.

18. Termination

Either party may terminate this Agreement with 14 days' written notice if the other party materially fails to meet their obligations and does not remedy the breach within 7 days of being notified. On termination, any work completed to that point will be charged at the agreed rate. Any prepayments for work not yet carried out will be refunded within 14 days.
